Real Estate Auction Terms and Conditions
The property will be offered in several individual parcels, any combination of parcels, or as a whole. There will be open bidding on all parcels and combinations during the auction as determined by the Auctioneer. Increments of bidding will be determined by the auctioneer. Property will be sold AS IS, no contingencies.
Buyer’s Fee: A 6% Buyer’s Fee will apply to this auction. Example of Calculation: $100,000 bid price + $10,000 Buyer’s Fee (10%) = $110,000 purchase price.
Terms: Within 3 days of the close of the auction, 10% per parcel (non-refundable) earnest money in the form of a certified check, cash, ACH, or wire transfer must be completed to Judd Realty LLC Trust Account. The balance of the purchase price will be due at closing. Purchaser(s) may be responsible for wire transfer fees incurred by their financial institution. Closing will be within 60 days or 5 days after the survey is recorded. This auction is a cash sale not contingent on or subject to financing, appraisal, or inspections of any kind, as agreed to by bidders at registration prior to bidding.
Auction company employees and/or the auction company may bid on auction items.
Acceptance of Bid Prices: Successful bidder(s) will be required to enter into a Vacant Land Offer to Purchase, with no contingencies, Addendum A to Offer to Purchase, Disclosure to Vacant Land, Managed Forest Law - Seller Disclosure and a Disclosure to Customer agreements immediately following the close of the auction. Unless the auction is noted as "SELLING ABSOLUTE," the seller has the right to accept, counter, or reject the bid. Buyers acknowledge and agree to waive any right to conduct inspections after the auction. All desired inspections must be completed by the buyer, at the buyer’s expense, prior to the auction.
Buildable Parcels: Only Parcel 2 will be buildable, Parcel 1 and 3 are not buildable.
Managed Forest Land: Parcel 2 and 3 is under the Managed Forest Law (MFL) program see lines 195-205 of the Vacant Land Offer to Purchase.
Growing Crop Land: Crops and Rents will stay with sellers for the 2025 growing season.
Evidence of Title: Seller shall provide an owner’s title insurance policy in the amount of the purchase price. The Real Estate Company will determine the title company to facilitate the closing.
Deed: Seller shall provide a warranty deed.
Gap Endorsement: Seller will not provide a “gap” endorsement or equivalent gap coverage at closing. If gap endorsement or gap coverage is required it will be at Buyer cost.
Surveys: All surveys required by the county will be paid for by the seller. The perimeter of total parcels will be used to determine county requirements.
Possession: Possession is at closing.
Real Estate Taxes: All taxes will be prorated to the day of closing using previous year’s tax amount.
Easements: Subject to any and all easement of record and mapped out. There will be an easement through parcel 1 to parcel 2 and from parcel 2 to parcel 3. This easement will be recorded with the survey and deeds.
Zoning: This property is subject to all state and local zoning ordinances.
Acreage: Parcel dimensions and acreages are based on legal descriptions.
Bidder Responsibilities: The identity of all bidders will be verified, bidding rights are provisional, and if complete verification is not possible, Hansen Auction Group, LLC will reject the registration, and bidding activity will be terminated. The seller and selling agents reserve the right to preclude any person from bidding if there is any question as to the person’s credentials, fitness, etc. Bidders agree to keep their username and password confidential as they are responsible for ANY and ALL activity involving their account. When using the website, you must obey any and all local, state, and federal laws. Violations will result in termination of website use privileges.
Agency: Hansen Auction Group, LLC, Judd Realty LLC and its representatives are agents of the Seller.
Buyer’s Agency: Buyers or real estate agents must notify Hansen Auction Group, LLC or Judd Realty LLC of any existing buyer agency agreements prior to registration and bidding, and no later than 24 hours before the auction closes. If the buyer's agency agreement includes a commission higher than the co-broke offered (e.g., more than 1%), the purchase price may be increased to cover the difference—provided it does not exceed the total commission amount agreed to in the buyer's agency contract.
