Real Estate Auction Terms and Conditions
The property will be offered as a whole. Increments of bidding will be determined by the auctioneer. Property will be sold AS IS, no contingencies.
Buyer’s Fee: A 6% Buyer’s Fee will apply to this auction. Example of Calculation: $100,000 bid price + $6,000 Buyer’s Fee (10%) = $106,000 purchase price.
Terms: Within 3 days of the close of the auction, 10% (non-refundable) earnest money in the form of a certified check, cash, ACH, or wire transfer must be completed to Judd Realty LLC Trust Account. The balance of the purchase price will be due at closing. Purchaser(s) may be responsible for wire transfer fees incurred by their financial institution. Closing will be within 30 days after signed Offer To Purchase by all parties. This auction is a cash sale not contingent on or subject to financing, appraisal, or inspections of any kind, as agreed to by bidders at registration prior to bidding.
Acceptance of Bid Prices: Successful bidder(s) will be required to enter into a Residential Offer to Purchase, with no contingencies, Addendum A to Offer to Purchase, Disclosure to Condition Report, and a Disclosure to Customer agreements immediately following the close of the auction. Unless the auction is noted as "SELLING ABSOLUTE," the seller has the right to accept, counter, or reject the bid. Buyers acknowledge and agree to waive any right to conduct inspections after the auction. All desired inspections must be completed by the buyer, at the buyer’s expense, prior to the auction.
Evidence of Title: Seller shall provide an owner’s title insurance policy in the amount of the purchase price. The Real Estate Company will determine the title company to facilitate the closing.
Deed: Seller shall provide a warranty deed.
Gap Endorsement: Seller will not provide a “gap” endorsement or equivalent gap coverage at closing. If gap endorsement or gap coverage is required it will be at the Buyers cost.
Possession: Possession is at closing.
Real Estate Taxes: All taxes will be prorated to the day of closing using previous year’s tax amount.
Easements: Subject to any and all easement of record.
Zoning: This property is subject to all state and local zoning ordinances.
Acreage: Parcel dimensions and acreages are based on legal descriptions.
Bidder Responsibilities: The identity of all bidders will be verified, bidding rights are provisional, and if complete verification is not possible, Hansen Auction Group, LLC will reject the registration, and bidding activity will be terminated. The seller and selling agents reserve the right to preclude any person from bidding if there is any question as to the person’s credentials, fitness, etc. Bidders agree to keep their username and password confidential as they are responsible for ANY and ALL activity involving their account. When using the website, you must obey any and all local, state, and federal laws. Violations will result in termination of website use privileges.
Agency: Hansen Auction Group, LLC, Judd Realty LLC and its representatives are agents of the Seller. Auction company employees and /or auction company may bid on the auction.
Buyer’s Agency: Buyers or real estate agents must notify Hansen Auction Group, LLC or Judd Realty LLC of any existing buyer agency agreements prior to registration and bidding, and no later than 48 hours before the auction closes. If the buyer's agency agreement includes a commission higher than the co-broke offered (e.g., more than 1%), the purchase price may be increased to cover the difference—provided it does not exceed the total commission amount agreed to in the buyer's agency contract.
